Utilities Now (“we” or “our”) is committed to protecting your privacy. The following information is provided to help you better understand the type of information Utilities Now collects from and about you when you visit our website (“Site”) and use our mobile applications (each an “App”). This policy applies to the Utilities Now Site, Apps, and any sales or support provided in person, telephonically, or via email or electronic messaging, collectively referred to as the “Services.”

Utilities Now is not responsible for the content or privacy policies of third-party websites. Third- party websites may collect personal information from our customers. Please be aware of the policies of all websites you may be linked or redirected to from the Utilities Now website.

The information we collect may include your name, address, email address, telephone or mobile number, date of birth, gender, social security number, photograph, and username.

  • Financial Transaction Information: Utilities Now collects information from you for financial transactions. When you pay for our products or services, we collect a credit/debit card number and related financial information (such as CVV, expiration date, and billing address), or other financial account information, depending on the form of payment you choose.
  • Survey Information: From time-to-time Utilities Now may conduct surveys of our customers and/or users of our Services. Surveys are completely voluntary to those using our Services. The surveys may require you to provide identifiable information in exchange for the information or services provided by the surveys. We may use this information in a non-identifiable way.

  • Location Information: Utilities Now collects information about your location based on your proximity to cell towers. We disclose this information as necessary to respond to 911 or other emergency-related situations as provided by law.

A. Information Use by or for Utilities Now 

Utilities Now may use the information we collect from and about you for any of the following purposes:

  • To respond to your inquiries, complete enrollment for use of our products and services, and contact and communicate with you when necessary.
  • To review the usage and operations of our Services and conduct analysis to enhance or improve our content, products, and services.

Additionally, if you use the Site or Apps to connect with third party services, you authorize us to use information from and about you, on your behalf, to interact with these third-party services based on your requests.

B. Information Use for Interest-Based Advertising 

We may use third parties to measure and target advertisements for us about our products and services that are tailored to your online interests. We allow these third- party companies to use cookies, web beacons, pixel tags and similar technologies to collect certain data and other information about your online activity. This information is used to display advertisements for Utilities Now on the Services or across other websites, mobile applications, social media, or online services that you use.

Utilities Now uses cookies to remember you when you log in to our Services so that we can provide you with customized content, such as your balance and other helpful services. C. Advertisements 

There may be advertisements that appear on the Utilities Now Site or Apps that will take you to a different website. These websites may ask for your personal information. Utilities Now has no control over our advertisers’ Privacy Policies, so please make yourself aware of any website’s Privacy Policies prior to providing your personal information.

D. E-Mail Communications 

Utilities Now will not disclose e-mail communications that are transmitted using Utilities Now services to third parties, except as required to provide service or as required to be disclosed by law.

E. Account Information 

To activate and access your account, you will be required to provide a password. You are responsible for remembering and maintaining the confidentiality of your password and are responsible for any activity conducted using your password.

Utilities Now wants to ensure that all account information is accurately reflected and will correct any incorrect information at the customer’s request. Customers may utilize the Services or contract Utilities Now to correct and verify account information.

5. Children’s Privacy 

Utilities Now does not knowingly collect information from anyone under the age of 18 without prior verifiable parental consent and may limit participation in certain services we provide to individuals over the age of 18.

Ordering online products and services from Utilities Now is limited to adults over the age of 18. However, wireless devices and services purchased for family use may be used by minors without the knowledge of Utilities Now. Any information collected from the usage will appear to be the personal information of the actual adult subscriber and be treated as such under this Privacy Policy.

6. Improper Conduct 

Utilities Now may use customers’ personal information to investigate and help prevent potentially unlawful activity or activity that threatens the network or otherwise violates the customer agreement for that service.

7. Data Security 

Utilities Now has implemented technology and security features, such as encryption, to safeguard the privacy of your customer specific information from unauthorized access or improper use and will continue to enhance our security measures as technology becomes available. Unfortunately, there is no such thing as foolproof security on the Internet, and therefore, Utilities Now makes no guarantees about the sufficiency of our security measures.

8. Data Storage 

Your personal information is stored on servers in the United States; however, some of our service providers may store information on servers hosted in other countries. As such, your personal information may be subject to the laws of other countries, where the data protection and other laws may differ from those of the United States. Your personal information may be disclosed in response to inquiries or requests from government authorities or to respond to judicial process in the countries in which we operate.

9. What Law Applies 

Customer specific information that is submitted to our Services will be collected, processed, stored, disclosed, and disposed of in accordance with applicable U.S. law. By providing us with your information, you acknowledge that you have read this Privacy Policy, understand it, agree to our Terms and Conditions of Service and consent to the transfer of such information outside your resident jurisdiction. If you do not consent to the terms of this Privacy Policy, please do not use our Services.

10. Policy Changes 

Utilities Now reserves the right to change our Privacy Policy from time to time based on our customers’ needs or to accurately reflect our legal obligations. Access and use of the Utilities Now Services constitute your acknowledgment and acceptance of such amended policy. This Privacy Policy does not create any legal right for you or any third parties.

11. Service Cancellation or “Opt-Out” 

Subscribers have the option to “opt-out” of service with Utilities Now at any time. Subscribers are under no obligation to continue use of wireless services with Utilities Now. To “opt-out” at any time, please call 1-888-859-4220.

12. Limitation of Liability. 

In no event shall Utilities Now, its affiliates, officers, directors, employees, agents, or representatives be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, lost profits or revenue, business interruption, loss of data, or any other damages) arising out of or in connection with this Privacy Policy, regardless of whether such damages were foreseeable and whether or not we have been advised of the possibility of such damages.
